The Crown Solicitor’s memorandum outlines some key principles of the Public Interest Disclosures Act 2022 (the PID Act). The memorandum focuses on a number of central concepts, principally as to the distinctions between different types of public interest disclosures and the kinds of “serious wrongdoing” on which they depend.
The memorandum is not intended to be a comprehensive statement of all the issues that may arise in deciding whether the protections contained in the PID Act are engaged. Many of those issues turn on highly evaluative and fact-specific enquiries, about which it is not possible to advise in the abstract. Instead, the memorandum is intended to draw out some key issues and expressions. Agencies should seek their own legal advice if they are faced with specific issues or questions in dealing with disclosures that are made.
